Under the Rules and Regulations governed by the Massachusetts Sex Offender Registration Board (SORB), individuals required to register as a sex offender have the ability to petition the Board for reclassification. Can you get relief from your obligation
to register as a Sex Offender in Massachusetts?

Under Massachusetts Law, an individual can petition the Sex Offender Registration Board for relief from his obligations to register if the following conditions are met:
1. Individual has not been determined to be a sexually violent predator;
2. Individual has not been convicted of 2 or more specified offenses having both occurred on separate occasions;
3. Individual has not been convicted of a sexually violent offense; or
4. Individual has not been convicted of a sex offense occurring with a child, and who has not already registered for at least 10 years.

How can I get my sex offender classification level lowered?

Under Massachusetts Law, an individual can petition the Sex Offender Registration Board for relief from his obligations to register by a written motion to the Board at least 3 years since the date of his final classification with new information of the offender that was not present at his final classification.

The motion for reclassification shall include the following information:
1. Sex offender number;
2. Name and address;
3. Classification sought with the reasons for such classification.

The motion shall provide proof by a preponderance of evidence that:
1. Since release, has not been incarcerated for at least a 5 year period;
2. Has not committed or been convicted of any additional sex offenses;
3. The risk of reoffense and degree of dangerousness has been reduced.

Registration Requirements for Sex Offenders

Level I
1. Shall register annually with the board;
2. Shall annually by mail verify the registration data on file is accurate;
3. Shall provide independent corroboration of current address;
4. Pay the applicable registration fee.

The public shall not have access to the sex offender registration information pertaining to Level I classification offenders. The police and/or board may release this information to various Government agencies as well as the victim of the offense upon written request.

Level II
1. Shall appear in person within 2 calendar days of receipt of the Board’s notification to the local police department in the city or town he lives;
2. The offender shall be photographed and fingerprinted;
3. Annually during the offenders month of birth, shall appear at the police station to verify information;
4. Independent verification of address;
5. Pay the applicable registration fee.

The public shall have access to sex offender registration information for level II offenders.

Level III
1. Shall appear in person within 2 calendar days of receipt of the Board’s notification to the local police department in the city or town he lives;
2. The offender shall be photographed and fingerprinted;
3. Annually during the offenders month of birth, shall appear at the police station to verify information;
4. Independent verification of address;
5. Pay the applicable registration fee.

The public shall have access to sex offender registration for level III and the police shall actively disseminate materials including where the offender works, lives and attends school.
